Official Contest Rules and Regulations and Terms

Term:  The “Roses On The Windshield” contest shall commence on April 15, 2009, 12p.m. Eastern Time, and contest will expire July 31, 11:59 p.m. Eastern Standard Time, 2009 (“Term”)

Eligibility:  All contest entrants must be of legal age, as determined by State and Federal law. Contest us is open to residents of the United States and Canada, wiht the exception of Quebec, except where prohibited by law.  Participants must be individuals at or above the age of 18 (eighteen) years of age at the time of submission and contest entry.  Employees, affiliated companies, directors, officers and/or relatives of Sponsors are not eligible to enter this Contest.  Contest is subject to all federal, state, and municipal laws.  By entering this Contest, all entrants agree to be bound by these Official Rules and Regulations and to comply with all federal, state and municipal laws and regulations.

Assignment of Rights and Declaration of Originality

By submitting your story and / or photo you hereby represent and declare that the story and/or photo is original with you and that you have committed no fraud, deception in connection with such submission(s) and assign all rights to your story and /or photo to Roses on the Windshield (roses) or (Paul Flood Marketing, LLC)  You agree, without compensation beyond the potential to win prizes described and/or to have your materials published, to permit (roses, Paul Flood Marketing,  LLC) to use, alter, publish, display or transfer (each, a “Use) your name, biographical material as submitted and /or story for any purpose required or desired by (roses, Paul Flood Marketing LLC) and / or its agents, affiliates, and/or subsidiaries. 

You further hereby waive all rights of inspection and release ( Paul Flood Marketing LLC) from any and all liability arising out of such Use of your name, biographical material, photograph or story.  You also release all rights in and to any claim of copyright, trademark, trade dress, or other intellectual property or other rights, royalties, commission or any payment whatsoever in connection with the Use of your name, biographical material as provided and / or photo or to remove it from the website, and therefore, you agree to allow such changes to be made for purposes of the Use(s) described above.

You certify that no other individual or parties hold copyright interest in the works submitted above and that you hold all rights to the works listed. You hereby certify and covenant that you are of legal age. 

All story and photo submissions come from the submitter and said submitter must of legal age (18) or as required by Federal or State laws.

How To Enter:

No purchase is necessary, although there is an application fee of $42.00 (forty-two) US Dollars, to be submitted to Paul Flood Marketing, LLC account per the submission instructions.

You must have Internet access as of April 15, 2009, in order to enter.  To enter visit http://www.rosesonthewindshield.com home page and click on “Rose Story Contest” or “Rose Photography Contest” and anytime during the “Term.” Review the Submission Guidlelines located at the web URL http://www.rosesonthewindshield.com/guidelines.php, for story guiedlines or  http://www.rosesonthewindshield.com/photo_guidelines.php for photo guidelines,and and complete the registration page by providing the information requested.

Please make sure that you have read and understood and checked the boxes the Photo Submission Guidelines or Story Submission Guidelines as well as the Assignment of Rights and Originality. Use of any automated entry software is prohibited. Sponsors and their affiliated companies are not responsible for, incorrect or inaccurate entry information, human error or technical malfunctions, illegible, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any computer equipment or software or any combination thereof or for lost, stolen, late, misdirected or mutilated entries.  All entries become the property of the Paul Flood Marketing, LLC, and will not be returned.

No photos or submissions will be considered that include actual or apparent likenesses to any persons, living or deceased.

Confirmation for receipt of application fee payment shall be received via email through your PayPal and/or major credit card account, from which it was sent.

Prizes :  There will be 6 (six) prizes consisting of:

1st Prize:  The two First Prize Winners will have their story / photographic submission used on the “1st Chapter / Front Cover” of “Roses on the Windshield” Book.  The first prize winners will also receive $2,000.00 U.S.  The winners shall also have their winning submission posted on www.rosesonthewindshield.com web site.

2nd Prize: The two Second Prize Winners will have their story / photographic submission used on the “2nd Chapter / Rear Cover” of “Roses on the Windshield” Book.  The second prize winners will also receive $500.00 U.S.  The winners shall also have their winning submission posted on www.rosesonthewindshield.com web site.

3rd Prize: The two Third Prize Winners will have their story / photographic submission used on the “3rd Chapter / Heading” of “Roses on the Windshield” Book.  The third prize winners will also receive $250.00 U.S.  The winners shall also have their winning submission posted on www.rosesonthewindshield.com web site.

Prize winners are responsible for paying Federal, State and Local income taxes that may be due on the cash prizes they have earned. Prize winnings will be reported to the Internal Revenue Service as required by law.

All individuals whose entries are chosen for as first, second or third prize winners have the option of receiving 12 (twelve) first editions of Roses on the Windshield personally autographed by Paul Flood, the author and publisher of Roses on the Windshield.

All individuals whose entries are chosen for publication may elect to publish their brief (75 words or less) company name or biographical information for self-promotional purposes along with their web site address (URL) at the end of their respective chapter.  The publisher
may revise or refuse content or descriptions to fit space allowed or delete offensive or illegal content.

Acceptance of these Official Rules and Regulations and submission of your story or photograph serves as permission to use
your photograph or story as allowed and defined above in Assignment of Rights and Declaration of Originality.

Any or all photograph or story submissions may be used and published elsewhere on internet web sites owned by Paul Flood Marketing, LLC for additional exposure and usage.

Judging:  The winner will be selected from among all eligible entries received throughout the “Term.” The judging will be conducted by the Sponsor – Paul Flood Marketing,, LLC and Sian Design.  Celebrity judge for the stories shall be provided by, New York Times, Bestselling Author, Mabel Iam, www.mabeliam.com, Celebrity Judge for the photography will be provided by world renowned photographer, Jim Zuckerman, www.corporatefineart.com .  All decisions of the Sponsor are final.  By entering this Contest, participants agree to abide by the Contest rules and recognize that the decision of the judging committee is final.

Prize Restrictions: Limit (1) Prize per individual.  The Prize is non-transferable.  No substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value, should the prize become unavailable.  The prize winners will be contacted by E-mail to the E-mail address provided on the registration page. If, after reasonable attempts to contact the winner(s), the potential First (1st) prize winner does not respond within fourteen (14) days of such notification, the entire prize will be forfeited and an alternate winner selected by Sponsor from among all eligible entries received during the “Term.” By accepting any prize, the winner consents to the use of his/her name, photograph or story for advertising/publicity purposes without further consideration, except where prohibited by law.  By entering, participants release and hold harmless Sponsors, subsidiaries, affiliates, directors, officers, employees and related “entities” (collectively, “Releasees”) from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, or use of the prize from or arising out of participation in the Contest.

Internet:  If for any reason this Contest is not capable of running as planned due to infection by computer, virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsors reserve the right, at their sole discretion to disqualify any individual who tampers with the entry process, and to cancel terminate, modify or suspend the Contest.  Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay, in operation or transmission, communications in line failure, theft or destruction or unauthorized access to, or alteration of, entries.  The Sponsors are not responsible for any failure of any e-mail entry to be received by the Sponsor on account of a technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participants or any other person’s computer relating to or resulting from participation in this Contest or downloading any materials in this Contest.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINDE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL, AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute as to the identity of a winner based on the e-mail address and contact information provided, the winning entry will be declared made by the authorized account holder of the banking or credit card payment account submitted at time of entry.  “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Force Majeure:  The failure of the Releasees to comply with any provision of these Official Contest Rules and Regulations due to an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Releasees (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official
Contest Rules and Regulations and terms.

By submitting your entry, you  warrant that you are of full age and have every right to contract in your own name in the above regard.  You further  state that you have read the above authorization, release, and agreement, prior to your submission, and that you are fully familiar with the contents thereof.
